1. DATA PROTECTION AT A GLANCE

General Information

The following information provides a simple overview of what happens to your personal data when you visit this website. Personal data is any data with which you can be personally identified. Detailed information on data protection can be found in our privacy policy listed under this text.

Data Collection on this Website

Who is responsible for data collection on this website?

The data processing on this website is carried out by the website operator. You can find their contact details in the section “Notice on the Responsible Body” in this privacy policy.

How do we collect your data?
Your data is collected firstly by you providing it to us. This could be, for instance, data that you enter into a contact form.

Other data is automatically collected or with your consent during your visit to the website by our IT systems. This is mainly technical data (e.g., internet browser, operating system, or time of the page visit). The collection of this data occurs automatically as soon as you enter this website.

What do we use your data for?

Part of the data is collected to ensure the error-free provision of the website. Other data can be used to analyze your user behavior.

What rights do you have regarding your data?

You have the right to receive information about the origin, recipient, and purpose of your stored personal data at any time free of charge. You also have the right to request the correction or deletion of this data. If you have given consent to data processing, you can revoke this consent at any time for the future. You also have the right, under certain circumstances, to request the restriction of the processing of your personal data. Furthermore, you have the right to lodge a complaint with the competent supervisory authority.

For this as well as further questions on the topic of data protection, you can contact us at any time.

Analysis Tools and Third-Party Tools

When you visit this website, your surfing behavior may be statistically evaluated. This is mainly done with so-called analysis programs.

Detailed information on these analysis programs can be found in the following privacy policy.

Web Analysis*

In order to continuously improve and optimize the content of our website and its usability, we use analysis technologies from Google LLC with the product "Google Analytics," "Google AdWords Conversion Tracking," and "Google Tag Manager." The session and interaction data of website visitors are collected and statistically evaluated for this purpose. Cookies are used for this purpose. The session and interaction data are processed exclusively anonymously and at no time in a personally identifiable form.

Partly, analysis data is transmitted to a server of the respective analysis service in a member state of the EU or in a third country outside the EU (e.g., in the USA) and stored there. The information may be transferred to third parties as far as this is legally permissible or as far as third parties process this data on behalf of our service provider. Neither we nor the web analysis services will associate your IP address with other data stored by us or the service provider. The website uses the following analysis services:

Google Analytics

This website uses Google Analytics, a web analysis service of Google LLC (1600 Amphitheatre Parkway, Mountain View, California 94043, USA). The IP anonymization function in Google-Analytics sets the last octet in IPv4 user IP addresses and the last 80 bits in IPv6 addresses to zero in memory shortly after being sent to the Analytics data collection network. As a result, the full IP address is never written to disk. More information on anonymization can be found here:  https://support.google.com/analytics/answer/2763052?hl=en

If you wish to disable Google Analytics, you can alternatively download a corresponding add-on for your web browser at https://tools.google.com/dlpage/gaoptout?hl=en.

Google AdWords and Conversion Tracking

We use the online advertising program "Google AdWords" and, within the framework of Google AdWords, conversion tracking. Google Conversion Tracking is an analysis service of Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; "Google"):

To draw attention to our services, we place Google-AdWords ads and use Google conversion tracking for personalized, interest-based, and location-specific online advertising. The option to anonymize IP addresses is controlled via an internal setting for the Google Tag Manager, which is not visible in the source of this page. This internal setting is set so that anonymization of IP addresses is achieved. The advertisements are displayed based on search queries on websites of the Google advertising network. We have the ability to combine our ads with certain search terms. With the help of cookies, we can display ads based on a user's previous visits to our website.

When you click on an ad, a cookie is placed on the user's computer by Google. Further information about the cookie technology used can also be found in Google's website statistics notices and in the privacy policy.

With the help of this technology, Google and we as customers receive information about whether a user has clicked on an ad and been directed to our websites. The information obtained from this is used exclusively for statistical evaluation and optimization of advertisements. We do not receive any information that can personally identify visitors. The statistics provided to us by Google include the total number of users who clicked on one of our ads and, if applicable, whether they were redirected to a page of our website that has a conversion tag. Based on these statistics, we can understand which search terms were particularly often clicked on our ad and which ads lead to a contact through the contact form by the user.

If you do not wish this, you can prevent the storage of the cookie required for these technologies, for example, through the settings of your browser. In this case, your visit will not be included in the user statistics.

You also have the option to choose the types of Google ads via the ad settings or to deactivate interest-based ads on Google. Alternatively, you can deactivate the use of cookies by third parties by accessing the deactivation assistance of the Network Advertising Initiative.

However, we and Google will continue to receive the statistical information of how many users visited this site and when. If you also do not want to be included in this statistic, you can prevent this with additional programs for your browser (e.g., with the Ghostery add-on).

Google Tag Manager

For reasons of transparency, we would like to point out that we use the Google Tag Manager. The Google Tag Manager itself does not collect any

personal data. The Tag Manager makes it easier for us to integrate and manage our tags. Tags are small code elements that, among other things, serve to measure traffic and visitor behavior, capture the impact of online advertising and social channels, set up remarketing and targeting audiences, and test and optimize websites. We use the Tag Manager for the following services: UET tag, AdWords Conversion Linker, AdWords Conversion Tracking, Analytics Tracking, and Analytics Event Tags. If you have deactivated something, this deactivation will be taken into account by the Google Tag Manager. For more information on the Google Tag Manager, see: https://www.google.com/intl/en/tagmanager/use-policy.html.

We point out that data transmission over the Internet (e.g., communication via e-mail) can have security gaps. A complete protection of the data from access by third parties is not possible.

NOTICE ON THE RESPONSIBLE BODY

The responsible body for data processing on this website is:

advercharge GmbH
Ob. Leimbach 2, 57074 Siegen, Germany

Phone: [phone number of the responsible body]
Email: [email address of the responsible body]

The responsible body is the natural or legal person who, alone or jointly with others, decides on the purposes and means of processing personal data (e.g., names, e-mail addresses, etc.).

Unless a more specific storage duration has been specified within this privacy policy, your personal data will remain with us until the purpose for data processing no longer applies. If you assert a legitimate deletion request or revoke consent for data processing, your data will be deleted, unless we have other legally permissible reasons for storing your personal data (e.g., tax or commercial retention periods); in the latter case, deletion takes place after these reasons cease to apply.

Note on Data Transfer to the USA and Other Third Countries

We use tools from companies based in the USA or other data protection unsafe third countries, among others. If these tools are active, your personal data may be transferred to these third countries and processed there. We point out that a data protection level comparable to the EU cannot be guaranteed in these countries. For example, US companies are obliged to hand over personal data to security authorities without you as the person concerned being able to take legal action against this. It cannot therefore be ruled out that US authorities (e.g., intelligence services) may process, evaluate, and permanently store your data located on US servers for surveillance purposes. We have no influence on these processing activities.

Revocation of Your Consent to Data Processing

Many data processing operations are only possible with your express consent. You can revoke an already given consent at any time. The legality of data processing carried out until the revocation remains unaffected by the revocation.

IF THE DATA PROCESSING IS BASED ON ART. 6 PARA. 1 LIT. E OR F GDPR, YOU HAVE THE RIGHT TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA AT ANY TIME FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. YOU CAN FIND THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED IN THIS DATA PROTECTION DECLARATION. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR AFFECTED PERSONAL DATA UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING THAT OUTWEIGH YOUR INTERESTS, RIGHTS, AND FREEDOMS OR THE PROCESSING SERVES TO ASSERT, EXERCISE, OR DEFEND LEGAL CLAIMS (OBJECTION ACCORDING TO ART. 21 PARA. 1 GDPR).

IF YOUR PERSONAL DATA IS PROCESSED FOR THE PURPOSE OF DIRECT ADVERTISING, YOU HAVE THE RIGHT TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA FOR THE PURPOSE OF SUCH ADVERTISING AT ANY TIME; THIS ALSO APPLIES TO PROFILING, AS FAR AS IT IS ASSOCIATED WITH SUCH DIRECT ADVERTISING. IF YOU OBJECT, YOUR PERSONAL DATA WILL NO LONGER BE USED FOR DIRECT ADVERTISING PURPOSES (OBJECTION ACCORDING TO ART. 21 PARA. 2 GDPR).

Right to Lodge a Complaint with the Competent Supervisory Authority

The right to lodge a complaint exists without prejudice to other administrative or judicial remedies.

Right to Data Portability

You have the right to have data that we process automatically on the basis of your consent or in fulfillment of a contract be handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done to the extent that it is technically feasible.

Information, Deletion, and Correction

Within the scope of the applicable legal provisions, you have the right to free information about your stored personal data, its origin and recipient, and the purpose of data processing, and, if necessary, a right to correction or deletion of this data at any time. For this and other questions on the subject of personal data, you can contact us at any time.

Right to Restrict Processing

You have the right to request that the processing of your personal data be restricted. For this, you can contact us at any time. The right to restrict processing exists in the following cases:

  • If you dispute the accuracy of your personal data stored with us, we usually need time to check this. For the duration of the examination, you have the right to request that the processing of your personal data be restricted.

  • If the processing of your personal data was/is unlawful, you can request the restriction of data processing instead of deletion.

  • If we no longer need your personal data, but you need it to exercise, defend or assert legal claims, you have the right to request that the processing of your personal data be restricted instead of deletion.

  • If you have lodged an objection in accordance with Art. 21 Para. 1 GDPR, a balance must be made between your interests and ours. As long as it is not yet clear whose interests prevail, you have the right to request that the processing of your personal data be restricted.

If you have restricted the processing of your personal data, these data may only be processed – apart from being stored – with your consent or to assert, exercise, or defend legal claims or to protect the rights of another natural or legal person or for reasons of important public interest of the European Union or a Member State.

SSL or TLS Encryption

This site uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or inquiries that you send to us as the site operator. You can recognize an encrypted connection by the change in the address line of the browser from “http://” to “https://” and by the lock symbol in your browser line.

If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

4. Data Collection on this Website

Cookies

Our Internet pages use so-called "cookies." Cookies are small data packets and do not cause any damage to your end device. They are either temporarily stored for the duration of a session (session cookies) or permanently (permanent cookies) on your end device. Session cookies are automatically deleted after your visit. Permanent cookies remain stored on your end device until you delete them yourself or automatic deletion is triggered by your web browser.

Cookies can come from us (first-party cookies) or from third-party companies (so-called third-party cookies). Third-party cookies allow the integration of certain services from third-party companies within websites (e.g., cookies for handling payment services).

Cookies have various functions. Many cookies are technically necessary because certain website functions would not work without them (e.g., the shopping cart function or the display of videos). Other cookies may be used to evaluate user behavior or for advertising purposes.

Cookies that are required to carry out the electronic communication process, to provide certain functions that you desire (e.g., for the shopping cart function), or to optimize the website (e.g., cookies to measure web audiences) are stored on the basis of Art. 6 Para. 1 lit. f GDPR, unless another legal basis is specified. The website operator has a legitimate interest in storing necessary cookies for the technically error-free and optimized provision of its services. If consent to the storage of cookies and comparable recognition technologies has been requested, processing is carried out exclusively on the basis of this consent (Art. 6 Para. 1 lit. a GDPR and § 25 Para. 1 TTDSG); the consent is revocable at any time.

You can configure your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general, as well as activate the automatic deletion of cookies when the browser is closed. If cookies are deactivated, the functionality of this website may be restricted.

Which cookies and services are used on this website can be found in this privacy policy.

If you send us inquiries via the contact form, your details from the inquiry form, including the contact details you provide there, will be stored by us for the purpose of processing the inquiry and in the event of follow-up questions. We do not pass on this data without your consent.

The processing of this data is based on Art. 6 Para. 1 lit. b GDPR, if your request is related to the fulfillment of a contract or is necessary to carry out pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective processing of inquiries addressed to us (Art. 6 Para. 1 lit. f GDPR) or on your consent (Art. 6 Para. 1 lit. a GDPR), insofar as this has been requested; the consent is revocable at any time.

The data you enter in the contact form will remain with us until you request deletion, revoke your consent to storage, or the purpose for data storage no longer applies (e.g., after your request has been processed). Mandatory legal provisions – in particular retention periods – remain unaffected.

Inquiry by e-mail, Telephone, or Telefax

If you contact us by e-mail, telephone, or telefax, your inquiry, including all resulting personal data (name, inquiry), will be stored and processed by us for the purpose of processing your request.

The data sent to us via contact inquiries will remain with us until you request deletion, revoke your consent to storage, or the purpose for data storage no longer applies (e.g., after your request has been processed). Mandatory legal provisions – especially retention periods – remain unaffected.
